Getting married in South Africa as a foreigner: documents, timing and costs

Updated 2 November 2026

The documents UK, EU and US couples need, how long it takes, private marriage officer versus Home Affairs, same-sex marriage, and what happens to your certificate afterwards.

Foreigners can marry legally in South Africa, and so can two foreigners with no South African partner. There is no marriage licence to apply for: a registered marriage officer conducts the ceremony and registers the marriage with the Department of Home Affairs. You need your passports with the entry stamp or visa, proof that each of you is free to marry, and documents that are less than six months old. With those in hand, a private marriage officer can usually act within days, which is why couples who arrive two to four weeks before the wedding manage it without trouble.

TipLast checked: 2 November 2026. The requirements on this page are summarised from the lists published by South African embassies (DIRCO) and the Department of Home Affairs. They change, and embassies apply them differently, so confirm the current list with Home Affairs, your marriage officer and your own country's embassy before you book flights.

The document checklist

DIRCO's embassy pages publish a list under the heading 'Requirements for foreigners to get married in South Africa'. For two foreign nationals marrying each other the core items are:

  • A valid passport for each of you, with the South African entry stamp or visa
  • Proof that you are free to marry: a letter of no impediment, certificate of no record of marriage or single-status affidavit, depending on what your country issues
  • An apostille on that proof, so that it is recognised in South Africa
  • Documents less than six months old at the date of the marriage
  • Where either of you has been married before: the final divorce order or the death certificate of a previous spouse

When both partners are foreign, a South African police clearance is not required. Where one partner is South African, Home Affairs applies additional checks because of its rules against marriages of convenience, and a law firm that handles these cases describes a five-document bundle for US citizens marrying South Africans. Allow extra time for a mixed couple.

Country notes

  • United Kingdom: the UK does not issue a letter of no impediment for marriages abroad. Couples instead obtain a standard letter from the British High Commission or consulate confirming the position, and have the supporting documents apostilled in the UK.
  • Germany: German nationals obtain an Ehefähigkeitszeugnis (certificate of no impediment) from their home registry office. The German embassy in South Africa publishes a consular page on marriage that sets out the process.
  • Netherlands: a certificate of marital status from your municipality, apostilled.
  • United States: there is no federal single-status document, so an affidavit of eligibility to marry sworn at the US embassy or consulate is the usual route, with any supporting documents apostilled by the issuing state.

These notes describe the documents that couples from each country have used; your embassy's own page is the authority. If a document is in a language other than English, bring a sworn translation.

Almost every destination couple uses a private marriage officer. The officer checks your documents, conducts the ceremony, has the register signed with witnesses and lodges the paperwork with Home Affairs. Ask each officer whether they are registered under the Marriage Act, the Civil Union Act or both, what their fee covers, whether they travel to Franschhoek or Tulbagh, and whether they can arrange the unabridged certificate and apostille afterwards.

Timing: when to arrive

Arriving two to four weeks before the wedding is workable if you have the right documents, because the officer only needs a few days. The time-consuming parts happen at home: obtaining the proof that you are free to marry, getting it apostilled, and making sure it will still be under six months old on the wedding day. Start that process about four months out so the document is fresh but not expired.

  1. Four months out: request your proof of single status or letter from your embassy and arrange the apostille.
  2. Three months out: book the marriage officer and send scans of every document for checking.
  3. On arrival: meet the officer, hand over originals, confirm the witnesses.
  4. Wedding day: sign the register after the ceremony. The officer lodges it with Home Affairs.

After the wedding: certificate, apostille and recognition at home

On the day you receive a handwritten or abridged certificate. The document most foreign registries want is the unabridged marriage certificate, which Home Affairs issues later. Couples report waits of up to a year through Home Affairs directly; private processing services and some marriage officers will chase it for a fee and arrange the South African apostille that your home country will usually require before it recognises the marriage. Whether and how the marriage is registered at home depends on your country, so ask your registry office or embassy what they need.

Same-sex couples

South Africa recognises same-sex marriage under the Civil Union Act. Not every marriage officer is registered under that Act, so confirm this before you book. Some of the officers listed on this site state that they hold both registrations.

Legal at home, symbolic here

If any of the above looks like more than you want to take on, do the legal part at home before you travel and hold a symbolic ceremony in the Winelands led by a celebrant. The ceremony looks the same to your guests, no documents are needed on this side, and there is no certificate to wait for. The Pink Book foreigner guide notes that ceremonies are often split this way. Our elopement and small weddings guide and our destination wedding guide both assume you have made this choice early, because it affects when you need to arrive.

Questions couples ask

Can two foreigners get married in South Africa?

Yes. Neither of you needs to be South African. You marry through a registered marriage officer with your passports, apostilled proof that you are free to marry and documents under six months old. Confirm the current list with Home Affairs or your embassy.

Do we need a South African marriage licence?

No. South Africa has no separate licence step. The marriage officer verifies your documents, conducts the ceremony and registers the marriage with Home Affairs.

The UK does not issue a letter of no impediment. What do we do?

British couples obtain a standard letter from the British High Commission or consulate and have their supporting documents apostilled in the UK. Ask your marriage officer whether that letter is what they expect before you travel.

Can we marry on a tourist visa?

The published document list asks for your passport with its entry stamp or visa, which is what a visitor holds. Visa rules change, so ask your marriage officer and Home Affairs to confirm that your entry status is acceptable before you book.

How long before the wedding should we arrive?

Two to four weeks is enough with a private marriage officer, who can register the marriage within days. A Home Affairs appointment needs six weeks or more, so that route rarely suits a visitor.

How long until we get the marriage certificate?

You get an abridged certificate on the day. The unabridged certificate from Home Affairs can take up to a year if you wait for it yourself; processing services and some officers will obtain it faster for a fee, together with the South African apostille most home registries require.

Is a South African marriage recognised in the UK, Germany, the Netherlands or the USA?

A legal South African marriage is generally recognised abroad once you present the apostilled unabridged certificate, but each country has its own registration process. Check with your registry office or embassy what they need and whether they require a translation.

Can same-sex couples marry in South Africa?

Yes, under the Civil Union Act. The marriage officer must be registered under that Act, so ask before booking. Several officers listed here state that they are.
